(“PersistIQ”, “Company,” “we,” “our,” or “us”) provides this Privacy Policy (“Privacy Policy”) because we know that you care about how your information is collected, used, shared and retained. This Privacy Policy applies to information collected when you purchase or use any of our Services, including visits to our website at www.persistiq.com (the “Website”).
By accessing or using our Service, you are agreeing to the terms of this Privacy Policy and the accompanying Terms of Service.
Capitalized terms not defined in this Privacy Policy shall have the meaning set forth in our Terms of Service.
How We Collect and Use Information
Contact Information
We collect information that you provide to us when you register for an account, purchase or use our Service, or communicate with us. Contact information typically includes your name, email address, and telephone numbers (landline and mobile), company name, and work email address. We use the contact information to provide you with the Service, participation in brief, voluntary surveys, customer support, or to contact customers and visitors for the purpose of direct marketing of our current and future services. We may ask that you voluntarily provide us with information for market research, interests, comments, and mailing list opt-in and opt-out information.
Billing Information
If you wish to purchase a product or service through the Website, you will be required to provide certain additional information which may include a credit card number, expiration date, billing zip code, activation code, and similar information (“Billing Information”). Billing Information is collected and processed by our third-party payment processor “Stripe.” PersistIQ does not directly obtain or process any Billing Information.
From Your Activity
In an ongoing effort to improve the Website, we automatically collect certain information regarding the activity of visitors to our Website and registered users when they purchase/use the Service. This information includes the device from which you access the Service, your IP addresses, browser type and language, referring and exit pages and URLs, date and time, amount of time spent on particular pages, what sections of the Website you visit, and similar information concerning your use of the Service.
Google User/G Suite Data
If configured, we sync with your G Suite email account to:
1. Allow you to send emails for your sales engagement campaigns
2. Store sales engagement emails and their replies to allow you to track the progress of your sales engagement campaigns.
Google Workspace APIs are not used to develop, improve, or train generalized AI and/or ML models.

From Cookies
Cookies are small packets of data that a website stores on your computer’s hard drive so that your computer will “remember” information about your visit. Remarketing and Advertising
We may share, or we may permit third party online advertising networks, social media companies and other third party services, to collect, information about your use of our website over time so that they may play or display ads that may be relevant to your interests on our Website as well as on other websites or apps, or on other devices you may use. Typically, the information we share is provided through cookies or similar tracking technologies, which recognize the device you are using and collect information, including hashed data, click stream information, browser type, time and date you visited the site, and other information. This information is used to display targeted ads on or through our Website or on other websites or apps, including on Facebook. CRM Data
We store our contact information within our Salesforce and HubSpot CRMs to help our sales and customer support team manage our relationships with current or prospective customers. Any personal data provided to/or collected by Salesforce or HubSpot will be used to provide our services in accordance with this Privacy Policy.
Aggregate Data
In an ongoing effort to better understand our users and the Website, we might analyze your information in aggregate form to operate, maintain, manage, and improve the Website. This aggregate information does not identify you personally. We may share this aggregate data with our affiliates, agents, and business partners. We may also disclose aggregated user statistics in order to describe our products and services to current and prospective business partners and to other third parties for other lawful purposes.
Onward Transfer to Third Parties
Like many businesses, we hire other companies to perform certain business and research related services. We may disclose personal information to certain types of third party companies but only to the extent needed to enable them to provide such services. The types of companies that now or in the future may receive personal information and their functions are: marketing assistance, error tracking, email management, payment processing, billing, customer service, data storage, and hosting services. All such third parties function as our agents, performing services at our instruction and on our behalf pursuant to contracts which require they provide at least the same level of privacy protection as is required by this Privacy Policy and implemented by PersistIQ.
Business Transfers
In the event of a merger, dissolution or similar corporate event, or the sale of all or substantially all of our assets, we expect that the information that we have collected, including personal information, would be transferred to the surviving entity in a merger or the acquiring entity. Disclosure to Public Authorities

Retention of Personal Information

We may continue processing your personal information for longer periods, but only for the time and to the extent such processing reasonably serves the purposes of archiving in the public interest, journalism, literature and art, scientific or historical research and statistical analysis, and subject to the protection of this Privacy Policy. Data Transfer
Our servers are located in the U.S.. If you are located outside of the U.S., please be aware that any information provided to us, including personal information, will be transferred from your country of origin. Except in the case of data transfers under the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield Framework, your decision to provide such data to us, or allow us to collect such data through our Website, constitutes your consent to this data transfer.

PersistIQ complies with the EU-US Privacy Shield Framework and the Swiss-US Privacy Shield Framework as set forth by the US Department of Commerce regarding the collection, use, and retention of personal information from European Union member countries and Switzerland transferred to the United States pursuant to Privacy Shield. PersistIQ has certified that it adheres to the Privacy Shield Principles with respect to such data. PersistIQ is subject to the investigatory and enforcement powers of the Federal Trade Commission.

You have the right to access, correct, amend or delete your personal data where it is inaccurate or has been processed in violation of this Privacy Policy. We may require payment of a non-excessive fee to defray our expenses in this regard. Please allow us a reasonable time to respond to your inquiries and requests.
We will provide an individual opt-out choice before we share your data with third parties other than our agents, or before we use it for a purpose other than which it was originally collected or subsequently authorized. In particular, PersistIQ remains responsible and liable under the Privacy Shield Principles if third-party agents that it engages to process the personal data on its behalf do so in a manner inconsistent with the Principles, unless PersistIQ proves that it is not responsible for the event giving rise to the damage.
In compliance with the Privacy Shield Principles, PersistIQ commits to resolve complaints about your privacy and our collection or use of your personal information transferred to the United States pursuant to Privacy Shield. European Union and Swiss individuals with Privacy Shield inquiries or complaints should first contact PersistIQ by email at [email protected].
PersistIQ has further committed to refer unresolved privacy complaints under the Privacy Shield Principles to an independent dispute resolution mechanism, the BBB EU PRIVACY SHIELD, operated by the Council of Better Business Bureaus. If you do not receive timely acknowledgment of your complaint, or if your complaint is not satisfactorily addressed, please visit www.bbb.org/EU-privacy-shield/for-eu-consumers for more information and to file a complaint. Additional Limits
Additional Limits on Use of Your Google User Data: Notwithstanding anything else in this Privacy Policy, if you provide the App access to your Google data, the App’s use of that data will be subject to these additional restrictions:
– The App will only use access to read, write, modify or control Gmail message bodies (including attachments), metadata, headers, and settings to provide a web email client that allows users to compose, send, read, and process emails and will not transfer this Gmail data to others unless doing so is necessary to provide and improve these features, comply with applicable law, or as part of a merger, acquisition, or sale of assets.
– The App will not use this Gmail data for serving advertisements, including retargeting, personalized, or interest-based advertising.
– The App will not allow humans to read this data unless we have your affirmative agreement for specific messages, doing so is necessary for security purposes such as investigating abuse, to comply with applicable law, or for the App’s internal operations and even then only when the data have been aggregated and anonymized.
App’s use of information received, and App’s transfer of information to any other app.
PersistIQ use and transfer to any other app of information received from Google APIs will adhere to Google API Services User Data Policy, including the Limited Use requirements.
External Websites
Our Website and Services may provide links to third-party websites or services that are not governed by this Privacy Policy. PersistIQ has no control over the privacy practices or the content of any of our business partners, advertisers, sponsors, or other websites to which we provide links. As such, we are not responsible for the content or the privacy policies of those third party websites. You should check the applicable third party privacy policy and terms of use when visiting any other websites.
Children’s Privacy
Our Website and services are intended for use strictly by adults. We do not knowingly solicit or collect personal information from children under the age of 13. If we learn that any personal information has been collected inadvertently from a child under 13, we will delete the information as soon as possible. Changes to This Privacy Policy
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy.
